Our Background
SADC
Mediation/Arbitration Centre is an initiative established to drive mediation/Arbitration
phenomenon as the ideal system for the resolution of private and public
conflicts. It is conceived project to give effect to Rule 41A of the Rules
Regulating the conduct of the proceedings of the several provincial and local
divisions of the High Court of South Africa. Under Rule 41A, the parties to
litigation can settle their cases arriving at compromise with the aid of
Mediators.
The
role of Mediators is to guide and assist the parties to explore the
possibilities of settlement and to know about the pros and cons of the
litigation / settlement. The role of SADC Mediation/Arbitration Centre is to
coordinate mediators and ensures that Mediators are available to the public.
SADC Mediation/Arbitration Centre is embarking on conflict avoidance and
dispute resolution strategies for private and public players / participants.
The
role of our Arbitrators is to solve dispute between the two sides without going
to Court. We are private judges.
The
Centre understood the potential of the system of Alternative Dispute Resolution
(“ADR”), is a much better resolution mechanism which private and public players
/ participants can use to resolve their cases instead of litigation. Mediation or
Arbitration are processes that are now in demand. The Centre seeks to resolve
disputes promptly because ADR does not delay proceedings.
The
Centre is targeting to mediate disputes which have not even come to our Courts,
to be settled during mediation. The Centre is primarily established to promote
awareness about the process of ADR and to create legal awareness about the
rights of the weaker and marginalized sections of the society.

Meet The Founder
Adv Katlego Mokwena
Practicing Advocate & Certified Mediator and Arbitrator
Adv. Katlego
Mokwena – Founder/ Director, Katlego is skilled in matters of law. He is a person of
high morale, creativity and great discipline. He studied undergraduate LLB
degree at the University of Limpopo.
He joined the National Bar Council of
South Africa in 2016 and former Deputy Chairperson of the Pupillage Board in
the National Bar Council of South Africa. He is an admitted and Practising
Advocate; a litigator of note, has excellent negotiation skills, a superb
drafter of legal documents.
